Terms of Service (User Agreement)

These Terms of Service ("Terms") govern your access to and use of the Shoeventory website, progressive web application, and related services (collectively, the "Service") operated by Shoeventory ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for ensuring your use of the Service complies with applicable laws.
2. Account registration and security
You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly of unauthorized access.
We may suspend or terminate accounts that violate these Terms, pose security risks, or remain inactive for extended periods where permitted by law.
3. The Service
Shoeventory helps you catalog and organize footwear and related items, including photos, tags, and metadata. Features may vary by plan. We may modify, suspend, or discontinue features with reasonable notice where practicable.
Free and paid plans. Certain plans limit the number of items you may store. Upgrading or downgrading may change available features. Subscription terms are described at checkout and in our Refund Policy.
4. Your content
You retain ownership of photos, text, and other materials you upload ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, display, and back up User Content solely to operate and improve the Service.
You represent that you have the rights to upload User Content and that it does not infringe others' rights or violate law. We may remove content that violates these Terms or applicable law.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes
- Upload malware or attempt to disrupt or gain unauthorized access to systems
- Harass others or collect personal data without consent
- Reverse engineer the Service except where law permits
- Resell or commercially exploit the Service without written permission
6. Subscriptions and payments
Paid plans are billed through our payment processor (e.g., Stripe). By subscribing, you authorize recurring charges according to the plan you select until you cancel. Prices and features may change with notice as required by law.

7. Privacy
Our Privacy Policy explains how we handle personal information. By using the Service, you acknowledge that policy.
8. Intellectual property
The Service, including software, branding, and design, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you ownership of our intellectual property.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
11. Indemnification
You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or where required by law. Upon termination, your right to use the Service ends; provisions that by nature should survive will survive.
13. Changes to these Terms
We may update these Terms. We will post the revised version and update the "Last updated" date. Material changes may require renewed acceptance at login or signup. Continued use after changes become effective constitutes acceptance where permitted by law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your country of residence.
Any dispute will be resolved in the state or federal courts located in New Castle, Delaware, and you consent to personal jurisdiction there, unless applicable law requires otherwise.
